Just Culture can be described as a risk-based approach to organizational performance. A key component of success in a Just Culture is the ability to draw the “bright line” between at-risk and reckless behaviors. Just Culture allows concentration of investigative and disciplinary resources to aggressively intervene with incompetent or unsafe practitioners rather than punishment for an isolated error. It focuses on quality improvement for those practitioners making errors, balances system and individual accountability for patient safety, and bases actions on behavioral choices/level of risk rather on the outcome of an incident.

Precautionary Procedures Prevent Due Process Paralysis

In a 2000 physician discipline case, Wyoming’s preponderance of evidence standard was overturned by the Wyoming Supreme Court. In 2001, the same court took great effort to direct vigilant separation between prosecutorial and advisory functions for all agencies sitting in contested case hearing. An overview of the cases involved demonstrates the need for constant reassessment of procedures and board member, investigator, staff and board Attorneys roles.
