    As early as 2018, the nurse regulators in British Columbia and Ontario, began to explore the next phase for registered practical nursing. The regulators engaged in generative and thoughtful discussions, and decided to create a registered practical nurse licensure assessment for those jurisdictions. In 2019, NCSBN conducted the REx-PN practice analysis, essentially analyzing entry-level practice behaviors in the noted jurisdictions. The data gathered in the study subsequently informed the 2022 REx-PN test plan, including the content distribution during exam delivery. Beginning with the launch of the exam in January of 2022, the test plan outlined the scoring methodology that would take place.

    Right now the courts are saying, "All right. Well, that's true..." Well, they're saying, "Because it's conduct not speech, we don't have to apply this strict scrutiny standard." Because they're saying, "All right. Well, what you're doing, you know, it is the practice of medicine or the practice of dietetics and you can't do that without a license. But it's conduct, so we don't have to apply this strict scrutiny question." They are actually inherently already doing the strict scrutiny question earlier on in the analysis, and that earlier on in the analysis of doing the strict scrutiny question is, was the licensure law allowed to be made in the first place?

    And I am certain that when you consult with the attorney for your jurisdiction, that likely will be the line that the attorney will take to try to sort of carve out arguments that some of the very concerning convictions are actually related to the practice. But to be honest with you, though, as an attorney, I feel quite pessimistic about that type of argument because of this work directly.     And so just for a point of reference, about 60% of the U.S. populace is white, and that means 40% would identify as a racial or ethnic minority. And so with that platform, we're going to see the state of diversity in the APRN workforce. And so the first slide that I'll share with you is from the National Center for Health Workforce Analysis from 2017. And so if you look at this data, which actually was derived between 2011 and 2015, for advanced practice registered nurses at that time, 84% of the APRN workforce was white. About 5.7% is black or African American, 4.5% self-identified as Hispanic, 4.1% as Asian, American-Indian self-reported less than a half a percentage, and Native Hawaiian and Pacific Islanders was not reported.
