My privilege to practice, that is what it's called. Likewise, if when I am practicing in that other state, if I were to violate the law and be disciplined, my privilege to practice in Virginia would be disciplined, okay? And that would be reported back to my home state.

But potential is only potential until a catalyst comes along and then takes the potential into actually a frank violation. Now, I'm going to give you examples of what all these elements are because, right now, it probably looks like a lot of gobbledygook, but I hope I can clarify it for you. So, what are risk factors? It could be practice type, practice location, for example, solo practice, clinical discipline, for example, psychiatry. ©2021 National Council of State Boards of Nursing, Inc. So in Florida, right, weeks before the sort of world shutdown for the COVID-19 pandemic, a really big thing had happened in Florida, and that's House Bill 607 was passed and signed by the governor. That bill has currently allowed for thousands of APRNs to have what's called autonomous practice in Florida and not practice under a physician protocol. So that was a huge achievement in Florida, but not without work left to do. The bill had a designation for primary care, so APRNs who practice the primary care had this pathway towards autonomous practice.

(4) What is the statutory authority in the Compact that supports passing rules that restrict how individual states enforce/regulate/issue their single state licenses? Dusty Johnston (TX) • Under the old compact rules a state could allow the licensee to practice in other party states with prior written authorization from both the home state and party state Boards. This has been a useful tool. What is the sentiment among the lawyers to allow this type of practice to have a place in the new eNLC without multiple single state licenses being issued to accomplish the same result?

The BON contacts the prosecutor who informs them that they estimate it will take 18 months to resolve the case. • Question: • Should the BON proceed with its investigation/disciplinary process or wait for the criminal case to be resolved? BEST PRACTICES Factors to consider: • Does our practice act allow for discipline relating to conduct outside of nursing? • Does our practice act require a conviction prior to discipline? • Can we issue a temporary suspension pending resolution of the criminal case for 18 months? • Do we have enough evidence to proceed prior to criminal case being resolved?

Will the nurse lose her/his license? Boards of Nursing are charged to protect the public. Their challenge is to weigh that responsibility with the right of an individual to practice a chosen profession. A nurse may be separated from practice if the Board determines that this is necessary to protect the public. However Boards utilize a variety of actions, and base the action chosen on the seriousness of the violation and the evidence that substantiates the violation. 14.
